Storage period

Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for processing it no longer applies. If you make a legitimate request for erasure or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible grounds for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once those grounds no longer apply.

General information on the legal bases for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, where special categories of data under Article 9(1) GDPR are processed. If you have expressly consented to the transfer of personal data to third countries, data processing is also based on Article 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g. via device fingerprinting), data processing is additionally based on Section 25(1) TDDDG. Consent may be withdrawn at any time. If your data is required to fulfil a contract or to take steps prior to entering into a contract, we process it on the basis of Article 6(1)(b) GDPR. We also process your data where necessary to comply with a legal obligation, on the basis of Article 6(1)(c) GDPR. Data processing may also be based on our legitimate interest under Article 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following sections of this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only disclose personal data to external parties if this is necessary to fulfil a contract, if we are legally obliged to do so (e.g. disclosure of data to tax authorities), if we have a legitimate interest in disclosure under Article 6(1)(f) GDPR, or if another legal basis permits the disclosure. When using data processors, we disclose our customers’ personal data only on the basis of a valid data processing agreement. If data is jointly processed, an agreement on joint controllership is concluded.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You may withdraw consent you have already given at any time. The lawfulness of data processing carried out before the withdrawal remains unaffected.

Right to object to data collection in specific cases and to direct marketing (Article 21 GDPR)

IF DATA PROCESSING IS BASED ON ARTICLE 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RELEVANT LEGAL BASIS FOR ANY PROCESSING IS SET OUT IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS NECESSARY FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ARTICLE 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED for direct marketing purposes (OBJECTION UNDER ARTICLE 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of a breach of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged infringement. This right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to receive, or have transferred to a third party, data that we process automatically on the basis of your consent or in fulfilment of a contract, in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done where technically feasible.

Access, correction and erasure

Within the scope of applicable legal provisions, you have the right at any time to obtain, free of charge, information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, where applicable, the right to have this data corrected or deleted. You can contact us at any time regarding this or any other questions about personal data.

Right to restriction of processing

You have the right to request that the processing of your personal data be restricted. You can contact us at any time to do so. The right to restriction of processing applies in the following cases:

  • If you contest the accuracy of your personal data stored by us, we will generally need time to verify this. While we carry out this verification, you have the right to request that the processing of your personal data be restricted.
  • If the processing of your personal data was/is unlawful, you may request restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to establish, exercise or defend legal claims, you have the right to request restriction of the processing of your personal data instead of its erasure.
  • If you have objected under Article 21(1) GDPR, a balance must be struck between your interests and ours. While it has not yet been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.

If you have restricted the processing of your personal data, such data may — apart from being stored — only be processed with your consent, or for the establishment, exercise or defence of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the website operator, this website uses SSL/TLS encryption. You can recognise an encrypted connection when the browser’s address bar changes from “http://” to “https://” and the padlock symbol appears in your browser bar.

When SSL/TLS encryption is enabled, the data you send to us cannot be read by third parties.

Objection to marketing emails

We hereby object to the use of contact details published in accordance with the legal notice requirements for sending unsolicited advertising and information materials. The website operators expressly reserve the right to take legal action in the event of unsolicited advertising, such as spam emails.

4. Data collection on this website

Cookies

Our websites use “cookies”. Cookies are small data files that do not cause any damage to your device. They are either stored on your device temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted when you leave the website. Persistent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies may be set by us (first-party cookies) or by third-party companies (so-called third-party cookies). Third-party cookies enable certain services provided by third-party companies to be integrated into websites (e.g. cookies used to process payment services).

Cookies serve various functions. Many cookies are technically necessary because certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies may be used to analyse user behaviour or for advertising purposes.

Cookies that are necessary to carry out electronic communications, provide certain functions you have requested (e.g. the shopping basket function) or optimise the website (e.g. cookies for measuring website traffic) (“necessary cookies”) are stored on the basis of Article 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies to ensure the technically flawless and optimised provision of its services. If consent has been requested for the storage of cookies and similar recognition technologies, processing is carried out exclusively on the basis of that consent (Article 6(1)(a) GDPR and Section 25(1) TDDDG); consent may be withdrawn at any time.

You can configure your browser to notify you when cookies are set, to allow cookies only in individual cases, to exclude the acceptance of cookies in specific cases or generally, and to activate the automatic deletion of cookies when you close your browser. If cookies are disabled, the functionality of this website may be limited.

This privacy policy explains which cookies and services are used on this website.

Consent with Borlabs Cookie

Our website uses Borlabs Cookie’s consent technology to obtain your consent to the storage of certain cookies in your browser or to the use of certain technologies, and to document this in compliance with data protection requirements. The provider of this technology is Borlabs GmbH, Rübenkamp 32, 22305 Hamburg, Germany (hereinafter “Borlabs”).

When you visit our website, a Borlabs cookie is stored in your browser, recording the consent you have given or the withdrawal of that consent. This data is not passed on to the provider of Borlabs Cookie.

The data collected is stored until you ask us to delete it, delete the Borlabs cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention periods remain unaffected. Details of data processing by Borlabs Cookie are available at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

Borlabs Cookie consent technology is used to obtain the legally required consent for the use of cookies. The legal basis for this is Article 6(1)(c) GDPR.

The website provider automatically collects and stores information in so-called server log files, which your browser automatically sends to us. This includes:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not combined with data from other sources.

This data is collected on the basis of Article 6(1)(f) GDPR. The website operator has a legitimate interest in ensuring the technically flawless presentation and optimisation of its website; to this end, server log files must be collected.

Contact form

If you send us enquiries using the contact form, we store the information you provide in the enquiry form, including the contact details you enter, in order to process your enquiry and in case we have follow-up questions. We do not share this data without your consent.

This data is processed on the basis of Article 6(1)(b) GDPR if your enquiry is related to the fulfilment of a contract or is necessary to take steps prior to entering into a contract. In all other cases, processing is based on our legitimate interest in effectively handling enquiries addressed to us (Article 6(1)(f) GDPR) or on your consent (Article 6(1)(a) GDPR), if requested; consent may be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. once your enquiry has been fully processed). Mandatory statutory provisions — in particular retention periods — remain unaffected.

Enquiries by email, phone or fax

If you contact us by email, phone or fax, your enquiry, including all personal data resulting from it (name, enquiry), will be stored and processed by us for the purpose of handling your request.

The data you send us in enquiries will remain with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. once your request has been fully processed). Mandatory statutory provisions — in particular statutory retention periods — remain unaffected.

5. Analytics tools and advertising

Google Analytics

This website uses features of the Google Analytics web analytics service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. The website operator receives various usage data, such as page views, time spent on the website, operating systems used and the user’s origin. This data is associated with the user’s device. It is not associated with a user ID.

Google Analytics also allows us to record your mouse movements, scrolling and clicks, among other things. Google Analytics also uses various modelling approaches to supplement the data collected and applies machine learning technologies in its data analysis.

Google Analytics uses technologies that enable users to be recognised for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). Information collected by Google about your use of this website is generally transferred to and stored on a Google server in the USA.

This service is used on the basis of your consent under Article 6(1)(a) GDPR and Section 25(1) TDDDG. Consent may be withdrawn at any time.

Data transfers to the USA are based on the European Commission’s Standard Contractual Clauses. Details are available here: https://business.safety.google/adscontrollerterms/sccs/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. You can find further information from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

IP anonymisation

Google Analytics IP anonymisation is enabled. This means that Google truncates your IP address within Member States of the European Union or other parties to the Agreement on the European Economic Area before it is transferred to the USA. Only in exceptional cases is the full IP address transferred to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide the website operator with other services relating to website and internet usage. The IP address transmitted by your browser as part of Google Analytics is not combined with other data held by Google.

Browser plugin

You can prevent Google from collecting and processing your data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

For more information about how Google Analytics handles user data, please see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Data processing agreement

We have entered into a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Meta Pixel (formerly Facebook Pixel)

This website uses Meta’s visitor action pixel to measure conversions. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Meta, the data collected is also transferred to the USA and other third countries.

This makes it possible to track the behaviour of website visitors after they have been redirected to the provider’s website by clicking on a Meta advertisement. This allows the effectiveness of Meta advertisements to be evaluated for statistical and market research purposes and future advertising activities to be optimised.

The data collected is anonymous to us as the operator of this website, and we cannot draw any conclusions about users’ identities. However, the data is stored and processed by Meta, meaning it may be linked to the user’s Facebook or Instagram profile, and Meta may use the data for its own advertising purposes in accordance with Meta’s Data Policy (https://de-de.facebook.com/about/privacy/). This enables Meta to display advertisements on Facebook and Instagram and on other advertising channels. As the website operator, we cannot influence this use of the data.

This service is used on the basis of your consent under Article 6(1)(a) GDPR and Section 25(1) TDDDG. Consent may be withdrawn at any time.

We use the advanced matching feature within Meta Pixel.

Advanced matching enables us to send Meta various types of data about our customers and prospective customers that we collect through our website (e.g. city of residence, state, postcode, hashed email addresses, names, gender, date of birth or phone number). This allows us to target our advertising campaigns on Facebook and Instagram more precisely to people interested in our services. Advanced matching also improves the attribution of website conversions and expands Custom Audiences.

To the extent that personal data is collected on our website using the tool described here and forwarded to Meta, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Article 26 GDPR). Joint responsibility is limited solely to the collection of the data and its transfer to Meta. Meta’s subsequent processing of the data is not part of this joint responsibility. Our joint obligations are set out in an agreement on joint processing. The text of the agreement is available at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing data protection information when using the Meta tool and for implementing the tool on our website in a manner that complies with data protection requirements. Meta is responsible for the security of Meta products. You can exercise your data subject rights (e.g. requests for access) regarding data processed by Facebook or Instagram directly with Meta. If you exercise your data subject rights with us, we are required to forward your request to Meta.

Data transfers to the USA are based on the European Commission’s Standard Contractual Clauses. Details are available here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.

Meta’s privacy information provides further details on protecting your privacy: https://de-de.facebook.com/about/privacy/.

You can also disable the “Custom Audiences” remarketing feature in the ad settings at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do this.

If you do not have a Facebook or Instagram account, you can disable usage-based advertising from Meta on the European Interactive Digital Advertising Alliance website: http://www.youronlinechoices.com/de/praferenzmanagement/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. You can find further information from the provider at the following link: https://www.dataprivacyframework.gov/participant/4452.

YouTube with enhanced privacy mode

This website embeds videos from YouTube. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of our pages that embeds YouTube, a connection to YouTube’s servers is established. This tells the YouTube server which of our pages you have visited. You can prevent this by logging out of your YouTube account.

We use YouTube in enhanced privacy mode. According to YouTube, videos played in enhanced privacy mode are not used to personalise browsing on YouTube. Ads shown in enhanced privacy mode are also not personalised. No cookies are set in enhanced privacy mode. Instead, so-called local storage elements are stored in the user’s browser. Like cookies, these may contain personal data and can be used to recognise users. Details about enhanced privacy mode are available here: https://support.google.com/youtube/answer/171780.

Activating a YouTube video may trigger further data processing operations over which we have no control.

We use the OpenStreetMap (OSM) mapping service.

We embed OpenStreetMap maps from the server of the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom. The United Kingdom is considered a safe third country under data protection law. This means that the United Kingdom provides a level of data protection equivalent to that in the European Union. This may transfer your IP address and other information about your behaviour on this website to the OSMF. OpenStreetMap may store cookies in your browser or use similar recognition technologies for this purpose.

OpenStreetMap is used to present our online services attractively and to make it easy to find the locations listed on our website. This constitutes a legitimate interest within the meaning of Article 6(1)(f) GDPR.
